In determining whether an injury is "serious", the courts will look at the impact the injury has had on a person's activities of daily living. Often insurance companies will dispute the severity of the impact an injury has had on the life of a limited tort claimant. As a full tort claimant, there is no limitation on your ability to recover economic or non-economic damages that are related to an auto accident.

There are some situations where a limited tort claimant is able to make a claim for damages as if the full tort option applied. The insurance company for an at-fault driver will rarely tell an injured person that an exception applies that would allow limited tort claimant to make a claim as if the full tort option applied.
