What is "bad faith"?
Bad faith is defined by Black's Law Dictionary as “any frivolous or unfounded refusal to pay proceeds of a policy…for purposes of an action against an insurer for failure to pay a claim, such conduct imports a dishonest purpose in means of breach of a known duty through some motive of self-interest or ill will…”.
And just as people have an obligation to provide honest information and make timely premium payments to their insurers, insurers also have certain responsibilities. But primarily, they have an obligation to act in "good faith" towards their customers.
This involves such areas as the insurers’ handling of an insured’s property damage claim, claims for first party or medical or wage loss benefits, an uninsured or underinsured motorist claim and liability claims brought against an insured.
